Admendment to the Fire Protection Services Regulations (Re: Adoption of New Code Editions)

The Fire Service Division, under the Department of Municipal Affairs and Environment, are pleased to announce an amendment to the Fire Protection Services Regulations. Effective January 18, 2019, the Fire Protection Services Regulations was amended to adopt the 2015 Edition of the National Building Code of Canada and the National Fire Code of Canada. This amendment has also directed the adoption of the 2018 edition of NFPA 101, Life Safety Code. The adoption is effective as of January 18, 2019. Also, to ensure a more efficient conversion to future code editions, another amendment to the Fire Protection Services Regulations directs the immediate adoption of future code editions, 6 months after their publication.

To ensure an appropriate amount of time is permitted around the submission of building design plans to Services NL, Engineering and Inspection Division, the attached notice provides a criteria for building design plan submissions.

Please review and distribute the attached notice to all stakeholder members and post prominently for viewing. An official copy of the Regulations is attached.

Re:                   Adoption of New Code Editions

 

An amendment to the Newfoundland and Labrador Regulation 45/12, Fire Protection Services Regulation, identifies the adoption of the following codes:

For the construction of all buildings:

  1. National Building Code of Canada, 2015 Edition, except Part 9 where relative to one and two family dwellings within Group C, and
  2. National Fire Code of Canada, 2015 Edition, and
  3. NFPA 101, Life Safety Code, 2018 Edition

For the use and operation of all buildings, processes, areas and vehicles:

  1. National Fire Code of Canada, 2015 Edition, and
  2. NFPA 101, Life Safety Code, 2018 Edition

Therefore, effective January 18, 2019, the new code editions were adopted as described. To ensure an appropriate amount of time is permitted around the submission of design plans to Services NL, Engineering and Inspection Division, the following is directed:

  1. Design plan submissions, currently in the approval process, will follow the previous code editions, and
  2. As of February 28, 2019, design plan submissions shall be required to follow the new adopted code editions, and
  3. Where a design plan is a work in progress and may be considered a larger scale project, please contact the Fire Service Division or Services NL, Engineering and Inspection Division to discuss the process.

To support a more efficient conversion to future code editions, an amendment to the Fire Protection Services Regulations, in Section 3 (1.1), directs the immediate adoption of further code editions and amendments to those codes, 6 months following the date of their publication.
